Freedom of Information

The Freedom of Information Act 1992 gives community members a legally enforceable right to access documents held by Queensland Government agencies and Ministers of the Crown.
Although the overall spirit of the Freedom of Information Act 1992 encourages the release of documents, some documents may be restricted to protect essential members of the community where disclosure would be contrary to the public interest. Restrictions on access may also be encountered for documents that have been placed in the custody of Queensland State Archives for safekeeping.

How do I access documents?

  1. You may be able to access documents without lodging a Freedom of Information application. In the first instance, you may contact the Department to see if the documents are available through either an administrative arrangement or purchase.

  2. Identify the documents you require, where they are available from (Division/location), what type of access is sought (inspection or copy) and method of collection (post or collection).

    To assist you in identifying the documents, you may wish to talk to the Departmental officers handling the documents to which you seek access.

  3. If it is determined that you are required to lodge a formal application under the Freedom of Information Act 1992, you may either do so by application form (PDF 38.3kb) or by letter.

    An application must:

    • be in writing;
    • state an address to which a notification of the decision may be sent;
    • be accompanied by a $36.00 application fee, if the information relates to non-personal matters (personal information about yourself is available at no cost); and
    • be addressed to the Administrative Law Officer.
  4. Post or deliver the application form or letter to:

  5. A $36.00 application fee is payable to access non-personal affairs documents. In addition, other charges may apply and you may be required to pay a deposit. A statement of any charges will be supplied to you. You will be notified of the decision on access to documents before full payment is required.
