If you operate a vineyard, or are otherwise involved in making wine in Queensland, and you wish to sell wine, you will need a licence under the Wine Industry Act 1994.
A licence may be held by:
- a company or partnership (with an individual as nominee); or
- a person over the age of 18 years (with or without a nominee).
Any licensee may hold more than one licence, but must have a separate nominee for each premises.
There are two licence types available under the Act . Each licence type relates to a distinct type of business and examples of each licence type are provided.
- Wine producer licence: applies where the proposed licensee operates a vineyard or winery in Queensland. The licence authorises the sale of wine made from fruit grown at the premises, or wine made at the premises.
- Wine merchant licence: applies where the proposed licensee does not operate a vineyard or winery, yet is conducting a business that contributes in a substantial way to the Queensland winery. Examples of operations that might be eligible for this licence include:
- Planting fruit that will be available for wine making at a later date, and using other fruit to make wine in the meantime;
- Having wine made in Queensland at the licensee's direction from Queensland fruit;
- Blending wines to create a unique product.
